1. Acceptance of Terms

By downloading or using the Warfarin Wise mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and NP Tech Wise, LLC ("we", "us", or "our").

2. Description of Service

Warfarin Wise is a personal health tracking application designed to help individuals on warfarin therapy track INR results, warfarin doses, vitamin K intake, symptoms, medication interactions, alcohol and cannabis use, reminders, and more. The App is intended for informational and personal tracking purposes only.

3. Medical Disclaimer & No Clinical Relationship

Warfarin Wise is not a medical device, not a clinical decision support tool, and does not provide medical advice, diagnosis, or treatment of any kind. All content within the App — including but not limited to information about vitamin K, drug interactions, INR values, warfarin dosing, symptoms, alcohol, cannabis, bridging therapy, and pregnancy — is provided strictly for general informational and personal tracking purposes only.

By using this App, you expressly acknowledge and agree that:

No patient–provider relationship is created between you and NP Tech Wise, LLC or any individual associated with the App.
You will not make any medical decision — including changes to your warfarin dose, timing, or therapy — based solely on information provided by this App.
You will always consult a licensed healthcare provider, physician, nurse practitioner, or anticoagulation clinic before making any change to your warfarin therapy or any other medical treatment.
The information in this App may be incomplete, outdated, or inapplicable to your specific medical situation.
Warfarin is a high-risk medication. Incorrect dosing can cause life-threatening bleeding or clotting events. You accept full and sole responsibility for all medical decisions you make.
The developer's clinical background does not create a professional duty of care to you as a user of this App.

In an emergency, call 911 or your local emergency services immediately. Do not rely on this App in an emergency situation.

4. Subscriptions and In-App Purchases

Warfarin Wise offers the following auto-renewable subscription plans:

Monthly Plan: $3.99 USD per month — provides full access to all app features for one month.
Annual Plan: $34.99 USD per year — provides full access to all app features for one year.

All subscription prices are in USD and may vary by region. Actual pricing will be shown in the app at the time of purchase.

Billing & Renewal

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
The cost of renewal will be the same as the original subscription price unless otherwise notified.

Managing & Cancelling Subscriptions

You can manage and cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period; you will retain access until that date. No refunds are provided for unused portions of a subscription period.

Restoring Purchases

If you previously subscribed and reinstall the app or switch devices, use the "Restore Purchases" option within the app to restore your subscription.

5. User Responsibilities

You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You agree not to:

Attempt to reverse engineer, modify, or create derivative works of the App
Use the App for any commercial purpose without our written consent
Attempt to circumvent any subscription or access controls

6. Intellectual Property

All content, trademarks, logos, and intellectual property within the App are owned by or licensed to NP Tech Wise, LLC. Warfarin Wise™ is a trademark of NP Tech Wise, LLC. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms. Warfarin Wise does not collect or transmit your personal health data. All data is stored locally on your device.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

NP TECH WISE, LLC SPECIFICALLY DISCLAIMS ANY WARRANTY THAT:

The health or medical information in the App is accurate, current, complete, or appropriate for your individual medical situation.
The App will meet your specific health management needs.
The App will be available, uninterrupted, error-free, or free of harmful components.
Any information obtained through the App will be reliable or suitable for clinical use.

YOUR USE OF THE APP AND ANY RELIANCE ON ITS CONTENT IS ENTIRELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NP TECH WISE, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING:

Any direct, indirect, incidental, special, consequential, or punitive damages;
Any personal injury, bodily harm, or death arising from or related to your use of the App or reliance on any information provided within it;
Any adverse medical outcome, including bleeding events, clotting events, stroke, or other complications related to warfarin therapy;
Any loss of data, loss of profits, or business interruption;
Any damages resulting from errors, omissions, or inaccuracies in the App's content.

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NP TECH WISE, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Assumption of Risk

You expressly acknowledge that warfarin therapy carries inherent medical risks and that managing such therapy requires the ongoing supervision of a qualified healthcare provider. By using this App, you voluntarily assume all risks associated with:

Using an informational app — rather than direct medical care — as any part of your health management;
Any decision you make regarding your warfarin therapy, diet, medications, or lifestyle based on or influenced by content in this App;
Any failure to seek timely professional medical advice.

You agree that NP Tech Wise, LLC is not responsible for any harm arising from your choice to use this App.

11. Indemnification

You agree to indemnify, defend, and hold harmless NP Tech Wise, LLC and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) any medical decision you make based on content from the App; or (d) your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the date at the top of this page. Your continued use of the App after any modification constitutes your acceptance of the updated Terms.

Apple Standard EULA: This app also incorporates the standard Apple End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between our Terms and Apple's standard EULA, Apple's EULA shall take precedence with respect to Apple's usage rules.
